As of May 2018, kratom is legal without restriction in the US state of Minnesota. There is no penalty for possessing any amount of the herb, nor selling or distributing within state limits. There have been no talks of pending legislature regarding kratom in the state, nor any news stories published on the web about possible concerns among local authorities.
The lack of movement against kratom in Minnesota may be because there is a substantial enough local following through advocate associations to keep politicians honest. For all American states, perhaps unsurprisingly, there is a distinct correlation between the absence of local advocates and anti-kratom legislation. There are also some geographical nuances that come into play—for instance, the west coast has a high-tolerance for what is considered “alternative medicines”, while the Midwest has low tolerance, if any. Of the handful of states that have outright bans on kratom, 60% of them are in middle America, with Minnesota falling just west of Wisconsin, where kratom is illegal. Many of the states along the Canadian border have developed west coast sensibilities when it comes to allowing their citizens to take alternate routes for their physical and mental well-being.
There doesn’t appear to be any current circumstances that would warrant a ban on kratom in Minnesota. Things could always change based on local reactions to the FDA’s classification, but signs point to an age restriction before a ban in Minnesota. Based on the seeming lack of public interest in restricting kratom and the absence of disparaging incidents indicates, kratom remain legal in Minnesota for now.

It was not that long ago that spice and bath salts were sold at smoke shops around the country and kratom is often, very unfairly, lumped into this category of product. Two, in our experience, smoke shop kratom is typically of lesser quality than kratom that can be purchased online from a reputable vendor. And three, kratom is often priced at incredibly high margins at smoke shops. For these reasons, we believe the kratom community is better served when purchasing the product from reputable online vendors.
