As of February 2018, kratom and its related products are legal to possess, sell, and distribute in Michigan without restriction. Its legal status of kratom in Michigan is up in the air due because of House Bill 5707, which is discussed below.
Legislature
House Bill 5707, or HB5707, is a bill that will add Mitragyna speciosa, the alkaloid that is the active ingredient in kratom, to its list of controlled substances. This would effectively make kratom illegal in the state of Michigan. The bill was introduced way back in 2014, and it has yet to pass the House. The wording that includes mention of kratom is as such:
MITRAGYNA SPECIOSA; ALL PARTS OF THE PLANT PRESENTLY CLASSIFIED BOTANICALLY AS MITRAGYNA SPECIOSA, WHETHER GROWING OR NOT; THE LEAVES AND SEEDS OF THAT PLANT; ANY EXTRACT OR RESIN FROM ANY PART OF THAT PLANT; AND EVERY COMPOUND, SALT, DERIVATIVE, MIXTURE, OR PREPARATION OF THAT PLANT OR ITS LEAVES, SEEDS, OR EXTRACTS.
A few change.org petitions to remove kratom from the bill were put forth by Botanical Legal Defense and Kratom Association of America, but each failed to gain enough signatures to garner support. Currently, there are no official protests or petitions enacted by kratom advocates in Michigan.
Going Forward
With pending legislation to ban the leaf in Michigan, kratom faces an uphill battle in the state, and the ineffectiveness of petitions in the state indicates that the advocacy may not be strong enough there to halt the proceedings. Advocates have time to form a movement to prevent a kratom ban in Michigan, because the sponsor of HB5707, Democratic Senator George Darany, retired in 2017.
